Terms & Conditions
1. Subject of Services
1.1 Holistic Counselor Isabel Spahr Carneiro undertakes to provide individual support to the client within the scope of the agreed counseling and therapy sessions.
1.2 Unless otherwise agreed, counseling and therapy services may only be used personally by the client.
1.3 The agreed counseling, therapy, and support services constitute a time-bound contractual obligation in accordance with § 611 of the German Civil Code (BGB).
2. Counseling & Therapy
2.1 Each session lasts 60–90 minutes. Shorter or longer sessions must be explicitly agreed upon. Early termination of a session by the client does not entitle them to a refund or credit of time.
2.2 The type, scope, and location of each session are agreed upon with the client. Possible content is discussed in advance during a consultation.
2.3 Sessions can only begin after a mandatory initial consultation and anamnesis.
2.4 Clients are responsible for informing themselves (if necessary with a physician) about any health risks associated with the counseling or therapy. Holistic Counselor Isabel Spahr Carneiro is not liable for self-inflicted accidents or risks.
3. Liability
3.1 The anamnesis form must be completed in full before the first session to ensure your health is not compromised.
3.2 Holistic Counselor Isabel Spahr Carneiro excludes any liability for damages that do not result from gross negligence or intentional breach of duty, including actions of vicarious agents.
3.3 Holistic Counselor Isabel Spahr Carneiro is not liable beyond providing the agreed services for the non-achievement of the purpose pursued by the client when entering the contract.
3.4 If clients make use of services provided by cooperation partners or other companies/persons introduced by Holistic Counselor Isabel Spahr Carneiro, this is done at the client’s own risk. Holistic Counselor Isabel Spahr Carneiro assumes no liability for goods or services received from these third parties.
3.5 Holistic Counselor Isabel Spahr Carneiro maintains professional liability insurance to cover any legal claims by clients.
3.6 Clients are responsible for insuring themselves against accidents or injuries that may occur during counseling or therapy, including travel to and from the location.
4. Payment Terms
4.1 Clients receive a written monthly invoice, which is payable in full within 7 days.
4.2 The currently agreed prices of Holistic Counselor Isabel Spahr Carneiro apply.
4.3 Any changes to address or bank details must be communicated immediately.
5. Other Costs
5.1 Costs for doctors, physiotherapists, nutritionists, osteopaths, or similar professionals consulted for holistic support are to be borne by the clients according to the billing terms of the respective provider.
5.2 Travel expenses are billed separately if counseling or therapy takes place outside Hamburg.
6. Online Sessions
6.1 In suitable cases, and under certain conditions, sessions may take place via secure video conferencing. The service provider ensures end-to-end encryption during the entire session, and no recording is allowed.
6.2 Any recordings require the prior written consent of both parties. Recordings without agreement are not permitted
7. Cancellations & Absences
7.1 Punctuality is requested to ensure effective counseling and therapy.
7.2 Clients must cancel at least 24 hours before the scheduled session. Otherwise, the full session fee will be charged.
8. Claims & Force Majeure
8.1 No claims for compensation arise from short-notice cancellations by Holistic Counselor Isabel Spahr Carneiro. Paid sessions will be credited or refunded on request.
8.2 If services cannot be provided due to force majeure, the client has no claim for damages.
9. Data Protection
9.1 Clients’ personal data are stored and used exclusively for the fulfillment of the agreed services.
10. Confidentiality
10.1 Clients must maintain confidentiality regarding any business or operational secrets of Holistic Counselor Isabel Spahr Carneiro, even after the termination of the agreement.
10.2 Holistic Counselor Isabel Spahr Carneiro is obliged to maintain confidentiality regarding all information learned during sessions, even after the agreement ends. All employees are also bound to confidentiality. In case of inquiries by insurers, caregivers, or doctors, written consent from the client is required to release the practitioner from confidentiality.
11. Other Agreements
11.1 Both parties acknowledge agreements and arrangements for booking sessions as binding if confirmed by both parties, via phone, WhatsApp, SMS, or email.
11.2 Both parties commit to mutual loyalty and will not make negative statements about the other party or their products/services, nor harm their reputation.
12. Final Provisions
12.1 Amendments, additions, and side agreements must be in writing to be effective unless stated otherwise in these T&Cs. The written form requirement also applies to the waiver of the written form.
12.2 If any provision is invalid or unenforceable, the remaining provisions remain effective. Invalid provisions will be replaced by a legally valid provision that best approximates the original economic intent.
12.3 The place of jurisdiction is Hamburg. German law applies.
